摘 要

改革開(kāi)放以來(lái),中國(guó)的民辦高等教育事業(yè)取得了令人矚目的成績(jī)。民辦高校教師作為民辦高??沙掷m(xù)發(fā)展的極為重要的一支力量,其合法權(quán)利的保障雖然在理論上得到了一定的重視,但在現(xiàn)實(shí)操作中,他們的合法權(quán)利卻沒(méi)有得到真正的保障。民辦高校教師的合法權(quán)利常常受到侵犯,申訴無(wú)門(mén),救濟(jì)不暢,維權(quán)部門(mén)形同虛設(shè),相關(guān)機(jī)構(gòu)缺乏監(jiān)管,可依據(jù)的法律政策又過(guò)于籠統(tǒng)缺乏可操作性。有鑒于此,本文從以下四個(gè)方面對(duì)民辦高校教師權(quán)利保障問(wèn)題展開(kāi)了研究。
第一部分,從相關(guān)概念入手,論述了民辦高校教師權(quán)利的含義及其內(nèi)容,按教師身份歸屬不同將民辦高校教師權(quán)利分為基本權(quán)利和職業(yè)權(quán)利;根據(jù)權(quán)利自身屬性不同,將其分為精神權(quán)利和物質(zhì)權(quán)利。
第二部分,闡述了當(dāng)前民辦高校教師權(quán)利保障的基本現(xiàn)狀及其存在的問(wèn)題,分析了導(dǎo)致民辦高校教師權(quán)利保障不力的種種原因,包括:觀念意識(shí)的落后;法律制度的不健全;社保及人事制度的不完善;民辦高校內(nèi)部權(quán)利制衡機(jī)制的缺失與維權(quán)機(jī)構(gòu)的虛設(shè);財(cái)力資源的嚴(yán)重短缺等等。
第三部分,主要通過(guò)借鑒美國(guó)和日本私立高校教師權(quán)利保障的成功經(jīng)驗(yàn),揭示出其對(duì)我國(guó)民辦高校教師權(quán)利保障的種種啟示。
第四部分,就民辦高校教師權(quán)利保障問(wèn)題提出了一系列對(duì)策建議:建立健全關(guān)于民辦高校教師權(quán)利的法律法規(guī)保障體系;構(gòu)建民辦高校教師權(quán)利保障的制度體系;探索適合我國(guó)民辦高校教師特點(diǎn)的社會(huì)保險(xiǎn)、養(yǎng)老保險(xiǎn)、醫(yī)療保險(xiǎn)以及商業(yè)保險(xiǎn)制度;構(gòu)建民辦高校內(nèi)教師權(quán)利保障的組織體系;提高民辦高校教師自我維權(quán)的主動(dòng)性,加強(qiáng)維權(quán)意識(shí)和提高維權(quán)能力。

Abstract

Since the reform and opening-up, private higher education of china develops very fast and have achieved remarkable achievements, in which the teachers are seen as a very important source. theoretically, they are highly valued, but in the real life, their legal rights are not properly met and guaranteed . Teacher’s legal rights in the private college are usually subjected to invasion and they have no place to report and can not be relieved smoothly. the section of maintaining the rights is unreal, the related organizations lack monitoring, law and policy which are based are so general as to lack maneuverability. Owing to this kind situation, this paper focuses on the study of the guaranteeing teacher’s rights in private college from four perspectives.
The first part states the meaning and contents of teacher’s rights in private college from the related concept which are divided into two kinds----basic rights and professional rights according to teacher’s status; spiritual rights and material rights according to their attribute.
The second part outlines the current situation of protection of teacher’s rights guaranteeing in private college, analyzes various reasons that cause bad protection of rights guaranteeing in private college, including backward of idea and consciousness; disfunctional law system; imperfection of social insurance and personnel system; lack of the right monitoring mechanism in inner partof the private college and nominal existance of the rightsmaintaining organization ; serious shortage of financial power resources.
The third part draws lessons from successful experiences of guaranteeing rights of some American and Japanese private higher education so as to get various apocalypses of teacher rights guaranteeing in Chinese private colleges.
The fourth part puts forward a series of problem-solving counter plans and suggestions about teacher's rights in the private college: build up a series of guaranteeing system of the teacher's rights in the private college; explore social insurance, endowment insurance, medical insurance and business insurance system that suits teacher's characteristics in the private college of our country; set up the organizational system of teacher’s right guaranteeing inside the private college; build up and perfect the educational administration management system of teacher’s right guaranteeing in the private college; enhance the initiative of self-protection of rights of the teachers in private college, strengthen the consciousness of safeguarding rights and enhance the ability of safeguarding rights.
