摘 要
中國共產(chǎn)黨農(nóng)村黨支部委員會與農(nóng)村村民委員會(簡稱村兩委)是我國農(nóng)村兩個(gè)重要的村級組織，在村莊的經(jīng)濟(jì)和社會發(fā)展中起著重要作用。然而，由于這兩個(gè)組織在性質(zhì)、權(quán)力來源、合法性基礎(chǔ)、運(yùn)行機(jī)制等方面的一些差異，導(dǎo)致“兩委”之間經(jīng)常發(fā)生沖突。解決“兩委”之間的矛盾，形成村莊發(fā)展的合力是更好地實(shí)施村民自治、建設(shè)社會主義新農(nóng)村的重要課題。基于此，從村兩委之間的利益相爭、村干部素質(zhì)不高、法律制度方面以及村支委和村委會的權(quán)力來源的不同等四個(gè)方面分析了農(nóng)村“兩委”間的矛盾和誘因，在此基礎(chǔ)上提出處理“兩委”關(guān)系的思路。即：首先、從制度模糊性入手，修改相關(guān)的法律、條例，使制度規(guī)范化、明確化；其次、合理界定二者權(quán)力的界限:完善權(quán)力的法律授予機(jī)制；第三、提高村兩委成員素質(zhì)，加強(qiáng)團(tuán)結(jié)；最后、治理村兩委關(guān)系的根本保證：嚴(yán)格的法律責(zé)任追究機(jī)制。作為一項(xiàng)重要的制度，在發(fā)展過程中出現(xiàn)種種問題是在所難免的，相信在各界的努力下，村兩委關(guān)系問題一定能夠得到治理，村民自治事業(yè)一定能夠健康發(fā)展下去。

Abstract
The CPC branches and the village committees in rural areas (Cun liang Wei) are China's rural two important village-level organizations, plays an important role in the village of economic and social development. Because they have many differences in the nature, source of power, legitimacy basis, operating mechanisms, such as the difference, resulting in "two committees" between recurrent conflict. Solve the "two committees" the contradiction between the development of villages formed a joint force is better implementation of village autonomy, and building a socialist new rural important subject.
