摘 要
工傷事故救濟(jì)發(fā)展至今,主要形成了三種方式:民事?lián)p害賠償、商業(yè)保險(xiǎn)、工傷保險(xiǎn)。尤其是民事?lián)p害賠償與工傷保險(xiǎn)補(bǔ)償己成為最基本的救濟(jì)方式,在兩者并存時(shí)如何處理的問題,關(guān)系到用人單位和勞動者雙方的切身利益。由于我國法律對如何處理兩者之間的關(guān)系并未做出一般性的規(guī)定,甚至相關(guān)規(guī)定之間也存在一些矛盾。本文主要對我國工傷保險(xiǎn)補(bǔ)償和民事侵權(quán)賠償作簡要的介紹,同時(shí)對工傷保險(xiǎn)責(zé)任與民事侵權(quán)責(zé)任兩種不同的責(zé)任方式產(chǎn)生的原因及兩者之間的關(guān)系進(jìn)行闡明,同時(shí)介紹各國在對工傷保險(xiǎn)責(zé)任與民事侵權(quán)責(zé)任并存時(shí)所選擇的不同的處理模式,總結(jié)利弊。

ABSTRACT
Employment injury accident relief development up to now, there are main three ways: civil damage compensation, the commercial insurance, work injury insurance. Especially civil damages compensation and work injury insurance has become the most basic relief way, problems in how to deal with the two co-exist, related to the vital interests of both employers and workers. Because our laws on how to approach the relationship between the general did not make provisions, and even there are some contradictions between the relevant regulations. This paper focuses on our work injury insurance compensation and tort damages for a brief introduction, the relationship between cause and responsibility for both the two injury insurance and tort liability arising from the different responsibilities between the way be clarified, also introduced in the countries of injury when the insurance liability and tort liability coexist chosen different processing modes, summarize the pros and cons.
